1. About the Site
The Site provides information about 43 Oncology’s independent service, repair, installation, parts, imaging, and physics support offerings for linear accelerators and related radiation oncology equipment. The Site is intended for use by healthcare facilities, physicists, biomedical engineers, and other industry professionals.
2. Informational Purposes Only
Content on the Site — including service descriptions, articles, guides, and resources — is provided for general informational purposes only. It does not constitute engineering, medical physics, clinical, regulatory, or legal advice, and it should not be relied upon as a substitute for the judgment of qualified professionals or the service documentation applicable to your specific equipment. Radiation therapy equipment should be serviced, calibrated, and operated only by qualified personnel in accordance with applicable regulations and manufacturer specifications.
3. No Service Agreement Formed Through the Site
Nothing on the Site constitutes an offer, quotation, warranty, or service agreement. All equipment service, repair, installation, de-installation, parts sales, and related services are governed exclusively by a separate written agreement, proposal, or purchase order between 43 Oncology and the customer. In the event of any conflict between the Site’s content and a written agreement, the written agreement controls. Submitting an inquiry or service request through the Site does not create a service relationship or any obligation on our part.
4. Independent Service Provider
43 Oncology is an independent service organization. We are not affiliated with, endorsed by, or authorized by Varian Medical Systems, Siemens Healthineers, Elekta, or any other equipment manufacturer. All manufacturer names, product names, and trademarks referenced on the Site — including Varian, Clinac, Trilogy, TrueBeam, Elekta, and Siemens — are the property of their respective owners and are used solely for identification purposes.
5. Acceptable Use
You agree to use the Site only for lawful purposes. You may not use the Site to transmit anything unlawful, harmful, or infringing; attempt to gain unauthorized access to the Site, the Partner Portal, or related systems; interfere with the Site’s operation, including through viruses, scraping, or automated bulk access; or misrepresent your identity or affiliation. You agree not to submit patient information or protected health information through the Site.
6. Partner Portal
Access to the Partner Portal is limited to authorized users. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate portal access at any time at our discretion.
7. Intellectual Property
The Site and its content — including text, graphics, logos, photographs, page layouts, and articles — are owned by or licensed to 43 Oncology, LLC and are protected by copyright and other intellectual property laws. You may view, download, and print content from the Site for your internal business evaluation of our services. 10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, 43 ONCOLOGY, LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, AND IT DOES NOT APPLY TO SERVICES PERFORMED UNDER A SEPARATE WRITTEN AGREEMENT, WHICH IS GOVERNED BY ITS OWN TERMS.

You agree to indemnify and hold harmless 43 Oncology, LLC and its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.
12. Privacy
Your use of the Site is also governed by our [Privacy Policy], which describes how we collect and use information.
13. Governing Law and Venue
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in New Jersey, and you consent to the jurisdiction of those courts.

We may revise these Terms at any time by posting an updated version on this page with a new “Last updated” date. Your continued use of the Site after changes are posted means you accept the revised Terms.
15. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and 43 Oncology regarding use of the Site.
